DECISION
About the mechanism to encourage the development of solar power in Vietnam

Pursuant to the June 19, 2015 Law on Government Organization; Pursuant to the Electricity Law dated December 3, 2004; The Law amending and supplementing a number of articles of the Electricity Law dated November 20, 2012; Pursuant to the November 26, 2014 Investment Law; Law amending and supplementing the Law on Investment dated November 22, 2016; Pursuant to the Construction Law dated June 18, 2014; Implementing Resolution No. 115/NQ-CP dated August 31, 2018 of the Government on the implementation of a number of specific mechanisms and policies to support Ninh Thuan province in socio-economic development, production stabilization, people's life in the period 2018 - 2023; At the proposal of the Minister of Industry and Trade; The Prime Minister promulgates the Decision on the mechanism to encourage the development of solar power in Vietnam.Chapter I
GENERAL PROVISIONS
Article 1. Scope This Decision stipulates the mechanism to encourage the development of solar power in Vietnam. Article 2. Subjects of application The subjects of application of this Decision include organizations and individuals participating in the development of solar power in Vietnam and other relevant organizations and individuals. Article 3. Interpretation of terms In this Decision, the following terms are construed as follows:- Electricity purchaser is Vietnam Electricity or a member unit authorized by Vietnam Electricity or another organization or individual that purchases electricity from the Seller or an organization that accepts rights and obligations of the electricity buyers. the above organizations according to the provisions of law
- Electricity seller means an organization or individual engaged in activities in the field of generating electricity from solar power plants or systems, or an organization or individual that receives the "rights and obligations" of the organizations and individuals mentioned above. above according to laws.
- Electricity distribution and retailing unit not under the Vietnam Electricity Group means an electricity unit not under the Vietnam Electricity Group that is granted an electricity activity license in the field of electricity distribution and retailing, purchasing and purchasing. wholesale electricity from electricity distribution units to retail electricity to customers using electricity.
- Solar power is electricity produced from photovoltaic panels according to the principle of converting light energy into electricity.
- Rooftop solar power system is a solar power system with photovoltaic panels installed on the roof of a building and with a capacity not exceeding 01 MW, connected directly or indirectly to the power grid. with voltage level of 35 kV or less of the Buyer.
- Grid-connected solar power project means a solar power project directly connected to the national grid, except for the provisions in Clause 5 of this Article.
- Floating solar power project is a grid-connected solar power project with photovoltaic panels installed on a floating structure on water.
- Ground solar power project means a grid-connected solar power project, except for the projects specified in Clause 7 of this Article.
- The commercial operation date of a grid-connected solar power project or part of a solar power project is the date on which the whole or part of the solar power project is ready to sell electricity to the Buyer and satisfies the following conditions:
Chapter II
Grid-connected SOLAR POWER
Article 4. Responsibility to purchase electricity from grid-connected solar power projects- The electricity buyer is responsible for purchasing all electricity produced from grid-connected solar power projects to the national grid system in accordance with regulations on electricity system operation and standards and regulations. electrical engineering; prioritizing dispatching to exploit the full capacity and generating power of solar power projects.
- The use of the Model Power Purchase Agreement for grid-connected solar power projects is mandatory in the electricity purchase and sale between the Seller and the Buyer who is the Vietnam Electricity Group or a member unit authorized by the Group. Power of Vietnam authorized.
- The term of the power purchase agreement for grid-connected solar power projects is 20 years from the date of commercial operation. After this time, the extension of the contract term or the signing of a new contract shall comply with the provisions of law at the time of signing the contract extension or signing a new contract.
- A grid-connected solar power project that has been approved by a competent authority before November 23, 2019 and has a commercial operation date of the project or part of the project in the period from November 1. From July 2019 to the end of December 31, 2020, the project or part of such project may apply the electricity purchase tariff of grid-connected solar power projects at the power delivery and receipt points specified in the Appendix to the Decision No. this.
- The electricity purchase price in the Electricity Purchase Price Schedule, exclusive of value added tax, is adjusted according to the fluctuation of the exchange rate of Vietnam dong to the US dollar (equivalent to UScents/kWh), the applicable exchange rate is the central exchange rate of Vietnam dong to the US dollar announced by the State Bank of Vietnam on the date the Seller issues the payment invoice. This electricity purchase price is applied for 20 years from the date of commercial operation.
- For Ninh Thuan province, the purchase price of electricity from grid-connected solar power projects is included in the electricity development planning at all levels and has a commercial operation date before January 1, 2021 with a total accumulated capacity. accumulated not exceeding 2,000 MW is 2,086 VND/kWh (excluding value added tax, equivalent to 9.35 UScents/kWh, according to the central exchange rate of Vietnam dong to US dollar set by the State Bank of Vietnam. announced on April 10, 2017 is 22,316 VND/USD), applied for 20 years from the date of commercial operation. The electricity purchase price is adjusted according to the fluctuation of the VND/USD exchange rate. - The purchase price of electricity from grid-connected solar power projects that do not meet the conditions in Clauses 1 and 3 of this Article shall be determined through a competition mechanism.
- The electricity purchase price specified in Clauses 1 and 3 of this Article is applicable to projects with an efficiency of solar cells greater than 16% or modules greater than 15%.
- The cost of purchasing electricity from grid-connected solar power projects mentioned in Clauses 1 and 3 of this Article is fully accounted for and included in the input parameters of the Group's annual wholesale and retail electricity price plan. Vietnam Electricity Group.
- Main equipment of a grid-connected solar power project must meet Vietnamese technical standards and regulations or international standards (IEC) or equivalent standards. The power quality of grid-connected solar power projects must meet the technical requirements on voltage, frequency and requirements for the operation of the national power system according to current regulations.
- The investment in the construction of grid-connected solar power projects must comply with the provisions of the law on investment, construction, electricity safety, land, fire prevention and fighting, environmental protection and other regulations. other provisions of relevant laws.
- Tax incentives, land use and water surface use for grid-connected solar power projects shall comply with relevant current laws.
- The Seller is responsible for the investment, installation, operation and maintenance of power metering equipment, lines and booster substations (if any) from the Seller's power plant to the connection point. to the electricity grid of the Buyer; organize the inspection, calibration and testing of power metering equipment in accordance with the law on measurement.
- The connection point shall be agreed upon by the Seller and the Buyer in accordance with the approved planning. In case the connection point is different from the point where the measuring equipment is located, the Seller shall bear the loss of power on the connection line and the loss of the power plant's booster transformer.
Chapter IV
TERMS ENFORCEMENT
Article 10. Responsibilities of state management agencies 1. Ministry of Industry and Trade a) Assume the prime responsibility for, and coordinate with the People's Committee of Ninh Thuan province, and the Electricity of Vietnam in monitoring grid-connected solar power projects with commercial operation dates that meet the requirements for enjoying the electricity purchase price to support the regulation. Decision in Clause 3, Article 5 of this Decision and in accordance with Resolution No. 115/NQ-CP dated August 31, 2018 of the Government on the implementation of a number of specific mechanisms and policies to support Ninh Thuan province's economic development. – society, stabilizing production and people's life in the period of 2018 - 2023; b) Organize, guide and coordinate with the People's Committees of the provinces and centrally-run cities to inspect and supervise the implementation of this Decision; c) Issuing the Model Power Purchase Agreement applicable to grid-connected solar power projects and the Model Power Purchase Agreement applicable to rooftop solar power systems in case the Power Buyer is Vietnam Electricity Group. Male or authorized member unit; d) Issue regulations on metering, recording of electricity output and payment for rooftop solar power systems with the participation of electricity distributors and retailers that are not under the Vietnam Electricity Group; dd) Coordinate with ministries, sectors and localities in mobilizing resources to promote the development of rooftop solar power programs; e) Study and complete the bidding mechanism for solar power projects, implementation roadmap and report to the Prime Minister for approval for nationwide deployment. 2. People's Committees of provinces and centrally run cities a) Coordinate and support investors in compensation, site clearance, infrastructure, and human resources for investment, implementation and development of solar power projects in the locality; b) Monitor and inspect the implementation of solar power projects in the locality according to its competence; c) Perform the task of state management of activities related to solar power in the locality according to the provisions of current law. d) Report to the Ministry of Industry and Trade on registration, investment and development of solar power projects in the locality. Article 11. Vietnam Electricity Corporation 1. The Vietnam Electricity Group is responsible for fully accounting for electricity purchase costs of solar power projects that have signed power purchase and sale contracts with the Vietnam Electricity Group or a member unit approved by the Vietnam Electricity Group. Research and invest in energy storage solutions for the system to ensure stable operation of the power system when integrating renewable energy sources. 3. Building a management information system on the development of grid-connected solar power and rooftop solar power nationwide. 4. Reviewing progress of grid projects to ensure capacity release of grid-connected solar power projects and rooftop solar power systems, without overloading the national power system. 5. Annually report to the Ministry of Industry and Trade on the status of solar power connection, total installed capacity and electricity output purchased from grid-connected solar power projects and rooftop solar power systems. Article 12. Effect 1. This Decision takes effect from May 22, 2020. 2.
